| Mr
Chan is a graduate of the University of Nottingham. Called to
the Singapore Bar on 24 May 2003, He practiced with the law firm
of Drew & Napier LLC before joining Tito Isaac & Co LLP.
Primarily a practitioner in the arena of civil litigation, Mr
Chan also advises on matrimonial, criminal and corporate matters.
Mr
Chan remains cognizant of the stresses faced by both individual
and corporate litigants. Where appropriate he aims for the practical
resolution of disputes and the forging of sound business relationships.
AREAS OF PRACTICE
Contentious Probate and Administration
Matters and/or cases which Mr Chan has been instructed upon as
counsel include:-
• Multi-jurisdictional dispute pertaining to the legacies
of an established businessman. Allegations were cast as to his
lack of mental capacity and free will when making such legacies.
• A contest made by family members upon two wills executed
by a wealthy businessman. Allegations were made by family members
that his primary caregiver unduly influenced him to execute wills
giving her the lion's share of his estate.
• A contest made by a grieving husband upon his late wife’s
last will and testament. The said will having left him nothing
despite his loyalty and publicly- known profound affection for
her.
• Multi-jurisdictional dispute. Allegations were made that
the deceased’s signature on her will was forged.
Trusts and Equitable Remedies
Matters and/or cases which Mr Chan has been instructed upon as
counsel include:-
• Successful businesswoman added her live-in boyfriend as
a joint account holder of her largest liquid asset. Her boyfriend
had not contributed any monies to the joint account but alleged
that he was entitled to its entirety when she passed away.
• Sought a declaration that a semi-detached property purchased
by the husband was intended to be jointly held with his wife.
After his demise, the developers had refused to accept status
of joint tenancy.
As Defence Counsel in Criminal Prosecutions
• AVA prosecution. Client had brought 6,600 birds, 14 cartons
of Kretek cigarettes and two cartons of beer into jurisdiction
via sea.
Matrimonial Issues: Custody, Care
and Control Issues, Maintenance, Nullity, etc
• Variation of maintenance claims by husband or wife.
• Procurement of custody, care and control orders.
• Variation of custody, care and control orders.
• Division of matrimonial property.
The nature of the cases mentioned above have required the taking
of instructions and liaison in jurisdictions such as: Australia,
Thailand, New Zealand and Malaysia.
